Article 1: (Sale Refusal)
Starry Night Company (hereinafter "the Company") may refuse ticket sales or forcibly rescind already concluded sales contracts in the following cases:
(1) When a customer makes a false declaration or fails to make a required declaration regarding matters determined by the Company.
(2) When a customer engages in behavior that inconveniences third parties or interferes with the Company's smooth sales operations.
(3) When a customer fails to complete the required procedures within the deadline notified by the Company.
(4) When a customer fails to follow the purchase method specified by the Company.
(5) When a customer selects bank transfer but fails to transfer the payment by the deadline.
(6) When a customer submits an application but does not complete payment.
(7) When a customer violates any other provisions of the service terms.
Article 2: (Service Suspension / Interruption / Changes)
The Company may suspend, interrupt, change, stop, discontinue, or delay event operations without refund in the following cases:
When normal service provision becomes impossible due to war, riots, disturbances, labor disputes, earthquakes, eruptions, heavy rain, floods, tsunamis, fires, power outages, spread of infectious diseases, or other emergencies.
The Company shall bear no responsibility to users or third parties for any such suspensions, interruptions, changes, stops, discontinuations, or delays.
Article 3: (Ticket Exchange / Change / Cooling-Off)
Tickets for which a purchase contract has been concluded cannot be exchanged, changed, or cancelled at the customer's request. Note that the cooling-off period does not apply to tickets sold at this event.
Article 4: (Loss / Theft)
The Company will not reissue tickets under any circumstances (including loss, theft, or damage).
Article 5: (Ticket Refund)
Regarding event cancellations due to the Company's own reasons (other than Article 2):
The Company will notify users and process refunds using the method determined by the Company.
If a ticket is damaged, lost, or excessively soiled, the Company will issue no refund.
Refunds are limited to the ticket price only and do not include payment fees, transportation, accommodation, or communication costs.
Article 6: (Disclaimer)
The Company shall bear no responsibility for damages incurred by customers or third parties due to delays in confirming or notifying ticket reservation outcomes, or situations where applications become impossible, caused by congestion of communication lines, computer system accidents, or other reasons not attributable to the Company.
Article 7: (Contract Formation)
Notification of contract formation for online applications is provided through the confirmation screen on the sales site and an application completion email.
Emails will be sent to the address provided at the time of application. Please ensure you can receive emails from: @snc-jp.com / @starrynight.company / @stores.jp
Emails may be filtered as spam. If you do not receive an email within one week, please contact us following the instructions on the website.
Article 8: (Payment Method)
Payment must be made using a method designated by the Company; no other methods may be used.
Credit card payments will be automatically processed on the date specified by the Company. Bank transfer payments must be made by the Company's deadline.
The payment method cannot be changed once selected.
Article 9: (Governing Law)
Japanese law shall apply to the formation, performance, and interpretation of these terms.
Article 10: (Jurisdiction)
- In the event of a dispute between users and the Company related to this service, the parties shall resolve the matter in good faith.
- If unresolved through discussion, the Kobe District Court or Kobe Summary Court shall be the court of exclusive jurisdiction for the first instance, depending on the amount in dispute.
Article 11: (Other)
These terms may be changed or supplemented without prior notice due to changes in the Company's business activities.
Supplementary provision: These terms shall be effective from October 27, 2022.
